1. Scope of Services
The Megamind provides digital agency services including, but not limited to, content
scheduling and automated posting across Meta (Facebook, Instagram), Google
(Business Profile), and other digital platforms. We act as a service provider to facilitate
your digital presence.
2. Authorized Access
By using our posting services, you grant The Megamind the necessary permissions to
access your third-party accounts via official APIs or provided credentials. You
represent that you have the legal authority to grant such access and that your use of
our services does not violate the terms of service of these third-party platforms.
3. Content Responsibility
You are solely responsible for the accuracy, legality, and appropriateness of the
content (images, text, videos) provided to us for posting. The Megamind does not claim
ownership of your content but requires a non-exclusive license to use, host, and
publish this content to fulfill our service obligations.
4. Prohibited Conduct
You agree not to use our services to distribute content that is:
Unlawful, defamatory, or infringing on intellectual property rights.
In violation of the Community Standards of Meta, Google, or other relevant
platforms.
Designed to transmit malware, spam, or perform unauthorized data scraping.
5. Intellectual Property of the Company
All software, proprietary tools, website designs, and trademarks belonging to The
Megamind remain the exclusive property of the Company. You are granted a limited,
non-transferable right to use our website and services as intended.
6. Limitation of Liability
The Megamind shall not be liable for any service interruptions, data loss, or account
restrictions imposed by third-party platforms (e.g., Meta or Google). Our total liability
for any claim arising out of these Terms shall not exceed the amount paid by you for
the specific service in question during the preceding month.
7. Indemnification
You agree to indemnify and hold harmless The Megamind and its employees from any
claims, damages, or legal fees resulting from your breach of these Terms or the
content published on your behalf.
8. Termination
We reserve the right to suspend or terminate your access to our services at any time,
without notice, for conduct that we believe violates these Terms or is harmful to other
users or our business interests.
9. Governing Law
These Terms are governed by the laws of India. Any legal action or proceeding related
to these Terms shall be brought exclusively in the courts located in Bangalore, India.
